PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES. They set out the rules that apply to your use of our mobile applications, games, website, and related services. Do not use the Services or make any purchase if you do not agree to these Terms.
IF YOU ARE UNDER THE AGE OF 18 (or under the age of majority where you live), you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
1. Who We Are
These Terms of Service ("Terms") govern your access to and use of the MathHero mobile applications and games (including the "MathHero" app), our website at https://mathhero.net/, and any related products and services (collectively, the "Services").

("MathHero," "MathHero Studio," "we," "us," "our").
"MathHero Studio" may be used as our brand/trade name. References to "MathHero" in these Terms refer to MathHero Pte. Ltd. unless stated otherwise.
The Android version of the Services may be distributed on Google Play under the developer/publisher account of SpeedyMind LLC (Armenia) ("Publishing Partner"), acting on behalf of MathHero Pte. Ltd.
2. Acceptance of These Terms
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (see Section 10).
If you are using the Services on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" refers to that entity.
3. Eligibility, Child Users, and Parent/Guardian Responsibility
The Services are designed for use by children, but purchases and permissions must be handled by a parent or legal guardian ("Parent/Guardian").
If you are a Parent/Guardian and you allow a child to use the Services on your device/account, you agree that:
- you are responsible for the child's use of the Services;
- you supervise use as appropriate for the child's age; and
- you are responsible for any purchases, settings, and permissions made through your Apple App Store or Google Play account (or any other distribution platform).
You must comply with all applicable laws when using the Services.
4. License and Permitted Use
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own non-commercial use.
You may not (and may not attempt to):
- copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Services or Content;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, except to the extent permitted by law;
- bypass, disable, or interfere with security or access controls;
- use the Services for any unlawful purpose or in violation of these Terms.
5. Prohibited Uses
You agree not to use the Services:
- (a) for any unlawful purpose;
- (b) to violate any local, national, or international law or regulation;
- (c) to infringe our intellectual property rights or the rights of others;
- (d) to harass, abuse, defame, intimidate, or discriminate against any person;
- (e) to submit false or misleading information;
- (f) to upload or transmit viruses or malicious code;
- (g) to spam, phish, scrape, crawl, or interfere with the Services;
- (h) to attempt to gain unauthorized access to any accounts, systems, or networks.
We may suspend or terminate access if you violate these Terms.
6. Accuracy of Information
We try to keep information about the Services accurate, but occasionally information may contain errors, inaccuracies, or omissions. We may correct errors and update information at any time without prior notice (including after you have submitted an order), to the extent permitted by law.
7. Third-Party Links and Resources
The Services may link to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party resources is at your own risk.
8. Billing, Subscriptions, Trials, and Refunds
8.1 Purchases through Apple App Store and Google Play
If you purchase a subscription or other paid features through the Apple App Store or Google Play, the transaction is processed by that platform and is subject to the platform's terms and policies.

8.2 Auto-renewal
If you enable auto-renewal, your subscription will renew automatically unless cancelled at least 24 hours before the end of the current billing period (platform rules may vary). You can manage or cancel your subscription in your Apple/Google account settings.
8.3 Pricing changes and availability
Prices, subscription terms, trial availability, and benefits may vary by country/region, taxes, promotions, and platform policies. We may change pricing or offerings as permitted by applicable law and platform rules.
8.4 Purchases outside app stores (if applicable)
If we offer purchases directly (for example, via our website), additional payment terms, refund rules, and consumer rights may apply and will be disclosed at purchase.
9. Intellectual Property
All rights, title, and interest in and to the Services, including all content, software, graphics, characters, music, audio, and trademarks ("Content"), are owned by or licensed to MathHero Pte. Ltd. Nothing in these Terms transfers any ownership rights to you.
You may not use our trademarks, logos, or branding without our prior written permission.

12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR ALWAYS AVAILABLE, OR THAT ANY DEFECTS WILL BE CORRECTED.
Educational content disclaimer: The Services are designed to support math practice and learning, but we do not guarantee specific outcomes or results for any individual user.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MATHHERO PTE. LTD., ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) SGD 1.00 OR (B) THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICES IN THE 1 MONTH BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless MathHero Pte. Ltd. and its affiliates, directors, officers, employees, and licensors from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Services.
15. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or if required for security, legal, or operational reasons. You may stop using the Services at any time.
Termination does not affect rights and obligations that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and dispute resolution).
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Services after changes become effective means you accept the updated Terms.
17. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of Singapore, without regard to conflict-of-law rules.
You agree that the courts of Singapore will have exclusive jurisdiction over any dispute arising from these Terms or the Services, except where prohibited by applicable law.
If you are a consumer, nothing in these Terms affects any mandatory rights you may have under applicable consumer protection laws.
18. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
